Mediation is a process where parties sit with an impartial person (mediator) in an attempt to find a solution to their dispute and ultimately reach a settlement.

Sample Mediation Language

For issues between tenants: In the event that a dispute or claim arises between residents of ___, [Property Manager or Authorized Agent] agrees to refer (“referral”) the residents to professional mediation services. This mediation is voluntary, and residents are free to decline to mediate after the referral.

For issues between the landlord and tenant: In the event that a dispute or claim arises relating to the resident’s rent/possession, [Property Manager or Authorized Agent] agrees to refer the matter to professional meditation services in an attempt to resolve the matter prior to pursuing legal remedies. If the resident agrees to participate in the mediation after the referral, the [Property Manager or Authorized Agent] also agrees to participate in the mediation.
